TERMS AND CONDITIONS
ORDER ACCEPTANCE
Affordable Water Treatments & Purification Systems of Manitoba, Inc. (“Affordable Water Treatments & Purification Systems of Manitoba” or “the Company”) retains the right to approve or decline any customer order. Merely possessing a price list or promotional materials does not constitute an offer for sale. The following terms and conditions form part of every confirmed order or purchase order. All orders must be submitted in writing. Any special modifications to assembled products must be clearly stated at the time the order is placed.
PRICING
Products sold by Affordable Water Treatments & Purification Systems of Manitoba are invoiced based on pricing effective at the time of shipment, FOB shipping point. All shipping and delivery costs are the responsibility of the buyer. While pricing is typically consistent with published Company price lists, Affordable Water Treatments & Purification Systems of Manitoba reserves the right to adjust pricing without notice. Temporary surcharges may be applied to orders in response to fluctuating CAD exchange rates with foreign currencies.
DELIVERY
In-stock products manufactured by the Company usually ship within 1 to 4 business days upon receipt of an order. Distributed stock items typically ship within 1 to 3 business days. Orders received before 2:30 PM local time are often dispatched the same day.
SPECIAL ORDERS: Bulk orders or items not held in inventory may require additional processing time. Rush orders on non-stock items may incur extra inbound freight charges. Orders totaling over $10,000 CAD for custom or commercial items require a 50% deposit before processing begins. Orders on accounts with overdue balances will not be fulfilled until satisfactory payment is made or alternative arrangements are established with the Credit Department. Items that are temporarily out of stock will be backordered and shipped upon availability. Affordable Water Treatments & Purification Systems of Manitoba is not liable for delays caused by events beyond its control.
SHIPPING
Most products are shipped via the most efficient method, including courier, freight truck, or common carrier. Freight prepaid and charged options are only available for approved open accounts. When purchase orders meet specified minimum thresholds for freight assistance (thresholds subject to change), a 2% freight allowance will be credited to the invoice (3% for AB, SK, and Maritime provinces). Full truckload (FTL) bottled shipments traveling over 500 km qualify for a 5% freight allowance. Additional charges may apply for international packaging, hazardous materials, or accessorial services such as tailgate, manual unload, or indoor delivery. These extra charges are the responsibility of the customer.
BILLING
All open account shipments require prior credit approval and a clear account balance. Standard payment terms are net 30 days from the date of shipment. Credit card payments are only accepted for COD accounts. The Company reserves the right to withhold open account privileges or switch to COD terms for overdue accounts. Past due balances are subject to a monthly 2% service charge. The minimum invoice amount is $50.00 CAD. For international shipments outside of Canada or the U.S., full payment must be made in advance via Visa, irrevocable Letter of Credit, or wire transfer, unless other arrangements are made.
CREDIT APPROVAL
New customers must complete the Company’s credit application. This may involve communication with the applicant’s listed financial and supplier references. Account approval and timelines will depend on the responses from these contacts. Until approved, all orders will be shipped COD (cash, Visa, MasterCard, or certified cheque). All merchandise remains the property of Affordable Water Treatments & Purification Systems of Manitoba until full payment is received. Responsibility for goods transfers to the customer once they leave the Company’s warehouse.
DAMAGED SHIPMENTS
Affordable Water Treatments & Purification Systems of Manitoba is not responsible for damage or loss occurring in transit. All deliveries should be carefully inspected prior to acceptance. If damage is suspected, note “subject to inspection for concealed damage” on the freight bill. It is the consignee’s responsibility to file claims with the freight carrier for any loss or damage.
ERRORS AND RETURNS
Errors made by Affordable Water Treatments & Purification Systems of Manitoba will be corrected at no cost to the customer. The Company will only accept returns of new, standard, and current products, in original packaging and accompanied by the original invoice, within 90 days of the shipment date. Returns of custom-built, special order, or commercial items are subject to the Company’s discretion and a minimum restocking fee of 25%. A Return Goods Authorization (RGA#) must be obtained before sending items back. Returns after 90 days are subject to a minimum 25% restocking fee or $35.00, whichever is greater. Return freight must be prepaid. Credit will be applied based on the value of accepted returned merchandise. Individual components from assembled products may be returned with a 25% restocking fee.
WARRANTIES AND DEFECTIVE PRODUCTS
The Company passes along all manufacturer warranties for products sold. For items manufactured by Affordable Water Treatments & Purification Systems of Manitoba, any product failing due to material or workmanship issues will be repaired or replaced within one year from the original shipping date. Warranty coverage is limited to the original equipment value and excludes other costs. The Company or its suppliers may choose to repair or replace defective items. If a replacement is sent in advance and the returned product is repairable, it will be returned at the Company’s expense and the advance invoice will remain. If the product cannot be repaired, a credit will be issued. Denied warranty claims and associated costs are the responsibility of the customer.
ACCUMULATED RETURNS
The Company does not accept bulk returns accumulated over time. Items must be returned within 60 days of identifying the defect or failure in order to be considered for credit or replacement.
ORDER CHANGES AND CANCELLATIONS
The Company will make reasonable efforts to accommodate changes or additions to existing orders without causing multiple shipments. Orders are processed upon receipt, and modifications made after processing or once shipping has begun may result in delays. Any order changes or cancellations require approval by Affordable Water Treatments & Purification Systems of Manitoba.
GOVERNING LAW
These terms and conditions shall be governed by the laws of the Province of Manitoba.
